On January 14, 2012 at approximately 1:30 PM Deputies were dispatched to the 1300 block of Hempstead 50 in reference to a theft of property.

Upon arrival deputies were advised that two white males where tearing down a old barn on Posted Property, Deputies made contact with David Thomas age 18  of Emmett, and Derik Wade Bain age 21 of Hope. Both stated that they saw the old barn and stated that they thought nobody would care if they tore down the barn. He thought nobody owned the property. He said that they were going to take the tin and sell it. David Thomas stated he saw the posted sign, but thought, it meant no fishing and hunting. Deputies made contact with the property owner who stated  that no one had permission to be on or take anything from the property.

Deputies ran a warrant check on both subjects. Dispatch advised Deputies that Derik Wade Bain had a warrant with the city for failure to appear.  Bain and Thomas were taken into custody for criminal trespassing and theft of property, Bain was also turned over to the city of Hope for the Failure to appear warrant. Both were transported to the Hempstead county detention center to await a first court appearance.
